Issue Position: End HRS 134

Issue Position

Date: Jan. 1, 2014
Issues: Guns

Civil & Individual Liberties are very dear to my heart, especially the First, Second and Fourth Amendments of the Bill of Rights which I feel are under constant attack by Local, State and Federal entities. I will continue the fight for the repeal of all unconstitutional laws and restoring abused Rights by the State.

Amendment II violations by the State

Did you know that Article I, Section 17 of the Hawaii Constitution is to the letter exactly the same as Amendment II of the Bill of Rights?

A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.

The Hawaii Constitution was later amended with an annotation containing the word "reasonable" infringements.

End HRS 134

It doesn't take much to read through the Hawaii Revised Statutes, Chapter 134 to realize that there is nothing "reasonable" about these laws; "permit to acquire", "registration", "burden falls on the individual to show reason to carry", "cannot defend yourself with a firearm when your home is being burglarized", "no open carry", "no bullet in chamber", "no magazine over ten rounds"... Hundreds of stipulations that infringe on an individual's rights. HRS 134 is unconstitutional simply because the Right of the People to Bear Arms is outlawed in Hawaii, unless you have connections and/or are part of the "machine"!

End the Firearms Registrations Department.

This department is only there for a single reason; disarming the public! Crimes are not solved because of registrations! Hawaii has had licensing and registration of guns for about 50 years. After all of the administrative expenses and inconvenience imposed on gun owners, police here cannot point to a single crime that has been solved as a result of those programs. Given Hawaii's remote island geography, this should be an ideal place to keep track of guns because movement in and out of the state is limited and legal importation is controlled. If registration is going to work anywhere, it should work here. Unfortunately, criminals seem to be able to get their hands on guns virtually any place in the world.

Restoring Individual Liberties:

Will bring freedom and respect for the Constitution to the forefront
Will let people exercise their right to self-defense
Will give people a choice
Will let people feel secure in their property
Will save taxpayers millions of dollars being wasted on bureaucracy that serves no purpose
Will boost local economy by allowing sales of goods and free markets
Will diminish crime
